California Uncontested Divorce Overview:
An uncontested divorce is where the Husband and Wife agree not to have a trial in their divorce case and put their agreement regarding the division of certain assets and debts into an agreement. These types of divorces are quicker than a contested divorce. Once you submit your information, we will prepare and send you the initial court documents to get your divorce case started. We will also send you instructions on how and where to file the documents. After the initial stage is done, we will send you a simple questionnaire for you to fill out and send back to us so that we can prepare the rest of the documents in order to finalize the case so that you can get your divorce judgment from the court.

Before you sue someone in small claims court,
- You should send him or her a demand letter asking for the money and give them a reasonable time to respond. If they don't respond, you can file your small claims lawsuit.
- As an individual plaintiff, you can sue another person or company and ask up to $7500.00. If you are a company, you can only ask for up to $5000.00. You can only file 2 claims in a calendar year and ask for more than $2500.00, but you can sue as many times as you want and ask up to $2500.00.

+ Dissolution:
A gentler sounding term for divorce used in California since 1970. Since a marital relationship is treated more like a business partnership in California, when the partnership ends, it is said to be dissolved.
+ Community Property:
Property and profits received by a husband and wife during the marriage. Community property is a concept which began in Spain and is only officially recognized in some states which were once under or influenced by Spanish or Mexican control, including California, Arizona, New Mexico, Texas, Nevada, Idaho, Washington and Louisiana
+ Separate Property:
In community property States, the property owned by one spouse which he/she acquired: a) before marriage, b) by inheritance, c) as a gift, d) assets traceable to other separate property such as money received from sale of a house owned before marriage, and e) property the spouses agree is separate property.
+ Irreconcilable differences:
This is the basis of the "no fault" grounds for dissolution in California. Any differences between a husband and wife that cannot be resolved by counseling or passage of time can constitute "irreconcilable differences."
+ Petitioner:
This is the label given to the individual who is initiating the Dissolution of Marriage, Legal Separation or Nullity action in court and filing the petition.
+ Respondent:
This is the label given to the individual who is served the Dissolution of Marriage, Legal Separation or Nullity petition. This individual is then required to respond to the Petition and is thus called the Respondent.
+ MSA or Marital Settlement Agreement:
An agreement whereby Husband and Wife agree to forego a contested trial in their Dissolution or Legal Separation action and instead settle their disputes pursuant to a written agreement. The MSA is then submitted to a family court judge along with a final judgment. The MSA can cover property division, debt division, child custody and visitation, child support and any other matters connected with the dissolution case.
