Power of Attorney Overview:

A power of attorney is merely a document giving another person the legal power to represent you or act on your behalf. There are essentially two kinds of powers of attorney: Financial and Health care. Financial Powers of Attorney are required in instances where third parties like banks, insurance companies, mortgage companies, real estate brokers, private individuals or government agencies are asked to rely on the authority of your agent in your absence. Health Care Powers of Attorney are used to give a third party authority to act on your behalf concerning health care matters when dealing with doctors, hospitals, dentists and other health care agencies. A Living Will is a form of a Health Care Power of Attorney where a person states his or her desires regarding medical treatments in certain medical circumstances. While a healthcare power of attorney may enable your agent (husband, wife, child, etc.) to authorize a surgery when you are unable to give permission, a living will could for example state your wish not to be kept alive if you are in a permanent vegetative state.
You can also have a Child Care Power of Attorney if you are leaving your children in the care of another person for an extended period of time and want that person to have the authority to make certain decisions regarding your children. These decisions could include decisions relating to emergency situations.

Power of Attorney Questions:

+ Can I give another person a financial power of attorney, but for a specific business deal?

Yes. You can limit the power of attorney for example to a sale or purchase of a specific real estate or business. You can also limit the powers of your agent to certain acts such as taking out a loan or signing a specific check.
+ Can I revoke a power of attorney that I have signed?

Absolutely. You will have to make sure that your agent is promptly notified of your intention to revoke the power in writing. It would also be wise to notify the third party such as the bank or real estate broker of your decision to revoke the power of attorney.
+ Who can I designate as an agent in my power of attorney?

This is an important decision. Since identity theft and fraud is a major concern, you should designate a person you trust. Generally any competent adult can act as your agent. However, each State has specific requirements as to who can act as an agent in particular situations. We will provide specific information regarding these instances when you purchase your power of attorney.
+ Should I notarize my power of attorney?

Generally, yes. Since you don't want a dispute as to the validity of the power of attorney, it would be wise to notarize your power of attorney. Most states have specific requirements for powers of attorney. We will provide you with state specific requirements after your purchase.
