Small Claims Overview:

Don’t take the law into your hands; take them to court!  If someone owes you money or your landlord refuses to return your security deposit, or you were involved in an auto accident, you can file a small claims lawsuit to recover for your damages.  Small claims trials are scheduled usually within 45 to 60 days of the date of filing.  The trial is informal and no attorney can represent any of the parties.  The judge listens to both sides, reviews your evidence (bills, photos, estimates, and other exhibits) and issues a ruling right away or sends you his/her decision within a couple days of the trial.  You don’t have an infinite time to file your claim.  You have to file your claim within the appropriate time (Statute of Limitations) or else you lose your rights.

Before you sue someone in small claims court:

  • You should send him or her a demand letter asking for the money and give them a reasonable time to respond. If they don't respond, you can file your small claims lawsuit.

  • As an individual plaintiff, you can sue another person or company and ask up to $7500.00. If you are a company, you can only ask for up to $5000.00. You can only file 2 claims in a calendar year and ask for more than $2500.00, but you can sue as many times as you want and ask up to $2500.00.

Small Claims:

If you were suing because:

+ You were injured

If you are suing because you were injured (auto accident, slip and fall, etc.), you can file a lawsuit for up to 2 years after you were injured.
+ You had a verbal agreement

If you are suing because you had a verbal agreement and the agreement was breached, you have 2 years to sue after the agreement was breached.
+ You had a written agreement

If you are suing because you had a written agreement and the agreement was breached, you have 4 years to sue after the agreement was breached.
+ You had property damage

If you are suing because you had property damage, you have 3 years to sue after your property was damaged.
+ Someone committed fraud against you

If you are suing because someone committed fraud against you, you have 3 years to sue after you find out about the fraud.
+ You are suing a government or public agency

If you are suing a government or public agency (the police, a city, a public transit agency.), you have 6 months to file a claim with that agency. The agency then has 45 days to make a decision on your claim. IF they don't make a decision within 45 days, then it is as if they denied your claim. If they reject your claim, you have 6 months to file a small claims lawsuit.
